A temática dos cartulários concelhios, conhecidos em Portugal como “tombos”, enquanto repositório das deliberações régias ou municipais, está a ganhar espaço na diplomática municipal portuguesa como meio privilegiado de compreensão da projecção da autonomia, autoridade e identidade dos concelhos. A lei de 1431 teve um papel importante na definição de uma matriz do tombo concelhio, aperfeiçoada com a experiência da aplicação do anterior modelo de regimento outorgado pelo corregedor João Mendes a vários concelhos ao longo da década anterior. Posteriormente, apesar de persistirem iniciativas autónomas dos concelhos para fixar e validar cópias da sua documentação num suporte mais perene, o enquadramento régio como autoridade legal sancionadora sobrepôs-se ao longo da Idade Moderna. Em simultâneo, os tombos deixaram de ser apenas repositórios de documentos e passaram a ser também potenciais veículos de uma memória, uma intencionalidade, uma ideologia e uma narrativa, não só na sua génese mas também em momentos posteriores por via da adição de estratos documentais ou da reorientação das suas funções. Apresentamos um breve enquadramento cronológico deste processo com base nas informações recolhidas nos tombos que sobreviveram, e disponibilizamos informação relativa às suas características físicas, datação, usos ao longo do tempo e conteúdos. **** The topic of council cartularies, known in Portugal as “tombos”, which were used as repositories for royal or municipal deliberations, is gaining ground within Portuguese municipal diplomatics as a preferred method of understanding the projection of council autonomy, authority and identity. The law that was approved in 1431 played an important role in defining a matrix for the councils’ tombo (registry), having been improved by the experience of the previous application of the model statute granted by the magistrate João Mendes to several councils throughout the previous decade. Later on, even though the councils continued to launch their own initiatives to secure and validate copies of their documentation in a more permanent way, the royal framework, in its capacity as the sanctioning legal authority, was the dominant method used throughout the Modern Age. Meanwhile, the tombos were no longer mere document repositories, and had become potential vehicles for memory, intentionality, ideology and narrative, not only in their inception but also subsequently, by way of adding document strata or redefining their roles. We will present a short chronological framework of this process based on the information collected from the tombos that have survived, and we provide information about their physical features, their dating, their various applications throughout time, and their contents.

Um olhar sobre o cartório medieval da câmara de Elvas (com transcrição integral do livro de receitas e despesas municipal de 1432-33), por Joana Sequeira e Sérgio Ferreira2021 •
Resumo: Este artigo centra-se no estudo de um inventário de documentação do cartório da vila de Elvas realizado em 1432, que se encontra inserido no único livro de receitas e despesas medieval do concelho que sobreviveu até aos nossos dias. É igualmente apresentada, em Apêndice, a transcrição integral deste livro de contas. No estudo, começa-se por discutir as circunstâncias e os objetivos da elaboração deste rol de documentos, passando-se depois à análise dos descritores documentais e propondo-se uma classificação estatística por tipo de assunto versado. Por fim, confronta-se o inventário quatrocentista com o atual inventário do arquivo, na tentativa de identificar alguns dos documentos referidos no inventário medieval e aferir a percentagem dos documentos sobreviventes. Abstract: This article examines an inventory of documents of the municipal archive of Elvas (Portugal) made in 1432 and that was included in the sole surviving medieval account book of the town. It also provides, in Appendix, the full transcription of this account book. The study starts by discussing the circumstances of production of this inventory and its objectives, followed by an analysis of the description of the documents, namely its subjects. Finally, this inventory is confronted with a contemporary inventory of the municipal archive, in an attempt to identify some of the documents referred to in the medieval inventory and to determine the “survival rate” of the medieval documents.

This book gathers four studies on the theme of the medieval codices of the Ius proprium regni (proper law of the kingdom), published during 2013 and 2014. It is the first methodical contribution to fill the gap in the history of Portuguese law around the books ofIus proprium in Portugal which, unlike the books of Ius commune, were never subjected to an inventory or systematic, chronological cataloging. This work contributes to the study of this enormous task of compiling and systematizing, in proper books, the multiple normative acts that were scattered throughout the first centuries of the Portuguese monarchy. The chronological coverage ranges from the first books of laws (Ordinations of the Kingdom) that appear in the documentation from the year 1390 (long before the conclusion of the Alfonse Ordinances in 1446) until the first legal form of the beginning of the sixteenth century, of the “Regiment of Officers of the cities, towns, and places of these kingdoms". In the introduction a summary was made on the law books prior to the rebirth of Roman law in the twelfth century (Visigothic Code, Hispana, and the Etymologies of Saint Isidore of Seville) and the status quaestionis for the books of Ius commune, which emerged after this legal rebirth.
Abstract: With this essay, we follow the footsteps of a late-medieval individual and the manuscripts he produced. This study shows how fruitful a thorough examination of the materiality of historical sources used by historians can be, which in turn can illuminate both the social careers of local administrative officials and their intimate connection and complicity with the royal administration. This work also encompasses the reform of the municipal charters, one of the main legislative initiatives of the administrative machine in the early Modern Age in Portugal, confirming that its planning and implementation began earlier than previously thought by historians. Finally, by closely pursuing through the centuries the transmission of the main manuscript sources used in this essay, one has a glimpse of the bureaucratic procedures and archival organization during this period in Portugal. Resumo: Com este trabalho pretende-se biografar e cartografar o percurso de uma personagem tardimedieval e dos seus manuscritos. O estudo evidencia o interesse de uma abordagem da materialidade das fontes históricas que os historiadores utilizam, a qual poderá iluminar não somente o percurso social dos oficiais administrativos locais, mas também a sua estreita ligação e cumplicidade com a administração régia. Este trabalho aborda ainda alguns aspectos da chamada reforma dos forais, uma dos principais iniciativas legislativas da máquina administrativa nos inícios da época moderna em Portugal, confirmando como o seu planeamento e início dos trabalhos precede as datas normalmente apontadas pela historiografia. Ao se seguir cuidadosamente a transmissão ao longo dos séculos das principais fontes manuscritas utilizadas neste estudo, entrevemos um pouco dos trâmites da burocracia e da organização arquivística durante a Idade Moderna em Portugal.

Resumo A vila de Santarém era uma das principais do Reino na Idade Média e Moderna. Seria de esperar que o seu arquivo contivesse um testemunho documental expressivo dessa importância para essas cronologias, como os atuais arquivos de Lisboa, Évora, Porto ou Coimbra. Pretende-se, com este trabalho, fazer um levantamento das referências aos documentos medievais e modernos do antigo cartório de Santarém, dado que muitos eruditos foram atraídos pela riqueza e dimensão do seu espólio, bem como ao seu uso ao longo da Idade Moderna, até 1810, data do aparente desaparecimento da documentação mais antiga. Os fragmentos de pergaminho medievais e modernos foram desprezados e ignorados por séculos e só começam a ser revalorizados a partir do século XX, fruto de iniciativas individuais de investigadores. Este trabalho descreve o que tem sido feito em Portugal neste campo e apresenta um inventário detalhado de 108 fragmentos portugueses encontrados na Torre do Tombo. Medieval and modern parchment fragments have been neglected and ignored for centuries on and only were appreciated in the 20th century, due to individual projects carried out by researchers. This work aims at describing what has been done in Portugal in this field and presents a detailed inventory of 108 Portuguese fragments found in the Portuguese National Archive (Torre do Tombo). Os foros extensos na Idade Média em PortugalExtensive fueros, or municipal customs and usages are small ius proprium medieval codes containing a microsystem of compulsory and punishing legal rules, issued to guarantee justice and safety within a determined neighborhood. Its compilation was fostered or at least prompted during the 13th and 14th centuries due to the rising of the new general legal order of the ius commune.
