Images of Eugenio Colmo "Golia"

Copyright violation. The author of all this images is Eugenio Colmo (pseudonym "Golia") an italian painter who died in 1967 (see en:Eugenio Colmo). So all this images will be copyrighted in Italy (source country) until 1967 + 1 + 70 = 2038.

It applies also to File:Touring1.jpg for which I have already started an indipendente deletion request since I didn't realized there we were hosting other files of this author --Civitas13 (talk) 17:47, 20 February 2020 (UTC)[reply]

You appear to be correct that these files should be deleted from Wikimedia Commons. However, as these files are not under copyright in the United States, and as File:Guerre 14-18-Humour-L'ingordo, trop dur-1915.JPG is used in two English-language articles on Wikipedia, I would prefer that it be moved or copied there before being deleted. Do you (or does anyone else reading this) know if there is an easier way to move the file to the English-language Wikipedia than downloading and reuploading the file there? Honestly I don't know: on English Wikipedia now I see that exists en:Template:PD-USonly that should be appropriate in this case but I don't know what is the best way to do the transfer. --Civitas13 (talk) 06:58, 21 February 2020 (UTC)[reply]
It is a been a month since the deletion request started but just now I discovered that exist {{PD-US-expired-abroad-delete}} that seems to be appropriate for this case (but it seems that can be used only by administrators to work) --Civitas13 (talk) 08:25, 29 March 2020 (UTC)[reply]
It appears that whilst File:Guerre 14-18-Humour-L'ingordo, trop dur-1915.JPG might violate copyright in Italy, the image is held at the German Prussian Heritage Image Archive (bpk). The copyright on the image is labelled simply "bpk". The image number is 00097402, entitled "L'Ingordo / Der Gierige." At least for viewers in Germany and the anglophone world, if not for other countries, is the BPK reference not enough? As in, could the citation simply be changed to "bpk" in order to close this deletion thread?--Wil_dur (talk) 17:18, 18 April 2020 (UTC)[reply]
@Wil dur: In my opinion I thinks that in it is not possible to act in this way. First of all the images hosted on Wikimedia Commons must be on public domain both in source country (Italy in this case -even if Prussian Heritage Image Archive hold a copy of it-) and in the United States: in this case we have the problem of Italy where it is not in public domain. Secondly I have some doubts that the image is in public domain also in Germany which seems to follow the rule of "life + 70 years" as Italy. In addition the Wikipedia page en:Prussian Heritage Image Archive says that, with few exception, the image are not in the public domain and also the section Copyright / Rights Clearance seems to confirm that; the weblink say also "On images, which show copyright protected artworks (protection till 70 years after the artist’s death), we indicate in the description of the preview image under the label “Rights” the name of the right owner, when known by us"; maybe doesn't write the name of the author only because they don't know the name (even if it is a bit strange since the illustration bear the signature) ? In my opinion the best way is to transfer the image locally in the Wikipedias that can legally use the image. --Civitas13 (talk) 17:09, 18 April 2020 (UTC)[reply]
