With the Maybury vs. Madison decision in 1803 the establishment of a few individuals as a check and balance in the governance of this country was established. While there have been egregious, unconstitutional based decisions made by the court over the centuries, the court does not rule by minority. The unconstitutional decisions have been corrected by amendments and constitutional substantiated decisions by later courts. undo
