On September 30, 2011, the [[crowdfunding]] site [[Kickstarter]] filed a request for [[declaratory judgment]] against this patent. They are asserting that the patent is invalid because the inventions it covers were either already known or were obvious at the time the patent application was effectively filed (July 9, 2002). ArtistShare is a label[1] for musicians and other creative artists which allows them to fund their projects utilizing a "fan-funding" model to allow the general public to directly finance, watch the creative process of the recording, and in most cases gain access to extra material from an artist.[2] It was founded in 2000 by Brian Camelio.

As of 2006, Grammy-winning jazz composer Maria Schneider had produced and financed two albums through ArtistShare.[3] Billy Childs, in 2006, and Brian Lynch and Eddie Palmieri in 2007 also won a jazz Grammy on the ArtistShare label.[1]
