Op 5 juni 2012 is de nieuwe Cookiewet in werking getreden. De OPTA heeft als toezichthouder de bevoegdheid om stevige boetes op te leggen bij overtreding van de nieuwe Cookiewet, al ontbreekt momenteel de mankracht om alle overtredingen te beboeten. Daar komt binnenkort echter verandering in. De OPTA gaat namelijk een geautomatiseerd systeem bouwen dat websites gaat controleren op het plaatsen van zogenaamde tracking cookies. Hierdoor wordt de pakkans aanzienlijk vergroot en naleving van de nieuwe regels des te belangrijker.
De nieuwe wet brengt echter nogal wat vragen met zich: want wat zijn nu precies functionele cookies? Wie is er verantwoordelijk voor third party cookies? Is er ook toestemming nodig voor het gebruik van Google Analytics? Vallen andere technieken om informatie te verzamelen ook onder de nieuwe regels? Kan toestemming voor meerdere websites worden verkregen?
Tijdens de meeting zullen Marianne Korpershoek en Femke Vos van Louwers IP|Technology Advocaten al deze vragen aan de orde stellen. Verder zullen er concrete tips en aanbevelingen worden gegeven voor naleving van de nieuwe Cookiewet. Marianne en Femke zijn gespecialiseerd in ICT en privacyvraagstukken en adviseren hun klanten veelvuldig over de juridische aspecten van het gebruik van cookies.
