Returning Resident Visas

Lawful permanent residents (LPRs) who have been out of the United States for more than a year (or more than two years with a re-entry permit) may be eligible for a Returning Resident (SB-1) Visa. To qualify, you must demonstrate that you were in LPR status when you left the United States; you departed from the United States with the intention of returning and you have not abandoned this intention; and you are returning to the United States from a temporary visit abroad and, if the stay was protracted, this was caused by reasons beyond your control and for which you are not responsible.

This process requires two interviews at the Embassy. The first will determine if you qualify for Returning Resident status; if a consular officer determines you do, the second interview will be for the Returning Resident immigrant visa. To apply for returning resident status:

  1. Fill out Form DS-117 (Application to Determine Returning Resident Status)
  2. Please submit the following documents to the Consular Section:
    • DS-117
    • copy of green card
    • passport copy
    • contact phone number and e-mail address
    • supporting documents with translations in English

The documents may be left at the Embassy’s North Gate or sent by mail. We will then schedule your initial appointment. Pay the DS-117 application fee at the Embassy at the time of the interview. At the end of the interview, the consular officer will determine if you qualify for the visa.

If your application is approved, we will schedule your immigrant visa appointment.
